Lifestyle Pivoting with Gilly Kennedy is a trading name of Crystal Tree Ltd. In these terms and conditions the expressions “we”, “us” and “our” are intended to refer to Crystal Tree Ltd (a company incorporated in Scotland with limited liability with Companies Registration Office number SC457475 and having its registered office at Paxton House, 11 Woodside Crescent, Glasgow, G3 7UL) which is the owner and operator of this website and “you” is intended to refer to any person visiting or using the website and purchasing our services.

The services and facilities which we make available to visitors to our website are offered on the clear understanding that the following terms and conditions apply in all cases. If you are not willing to avail of the resources made available via this website on the basis of these terms and conditions you should leave this website immediately.

1) The information provided on this website and via our services is for general information purposes only. We make no representations or warranties of any kind, express or implied, about the accuracy of the information provided. In the event that you do rely on any such information for any purpose whatsoever this will be at your sole risk and no liability of any kind will accrue to us as a consequence of such reliance.

2) If you sign up for the Lifestyle Pivioting App you will be offered 3 payment options 

• Pay Monthly at £49.99 per month on a pay as you go basis.
• 12 Month Discount at £479 single upfront payment (equivalent to 12 x £39.99 per month).
• 12 Month VIP (£195 per month x 12 or alternative payment option by agreement).

Once paid none of the fees or any part of it is refundable. If you are paying by instalment, all payments are payable in full in all cases with no exceptions.

If you are paying monthly on a pay as you go basis, you may cancel anytime with one month's notice. Cancellation requests are to be made in writing to Gilly Kennedy, Paxton House, 11 Woodside Crescent, Glasgow, G3 7UL or send an email to be sent to gilly@lifestylepivoting.com.

3) We always want the best for our clients and give 100% support in helping them achieve results, and we have an incredible track record with our clients, however we cannot guarantee that you or any participant will achieve any specific result as a result of using any of our services. Our signature coaching program Lifestyle Pivoting in 30 Days, featured on the Lifestyle Pivoting App, is tried and tested and we are confident your joy level will increase as you work through the program. That said, we offer you unlimited one to one support and if you find your joy level is not increasing after completing the program, we will continue to support you as long as you are signed up for the App.

4) All payments are accepted using Stripe Payment Processor and are taken in the currency GBP.

5) We use Stripe Payment Processor for processing your payments.

6) Refund Policy. You have the right to cancel your purchase of any of our services within 7 days. Any payment you have made at that point will be refunded in full back to the credit card you made the purchase with. In order to cancel your purchase write to Gilly Kennedy at Paxton House, 11 Woodside Crescent, Glasgow, G3 7UL or send an email to gilly@lifestylepivoting.com. Please note your access to the services will be terminated when you cancel and any downloading of content or copying of content and materials will not be permitted.

7) We are the owners of the copyright of all content on our website and all materials provided through our services. All materials provided are for your individual use only. You are not authorised to use any of our intellectual property for any business purposes. All intellectual property shall remain our sole property. No license to sell or distribute our materials is granted or implied. By purchasing our services, you agree not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights.

8) From time to time our materials may include links to other websites. These links are provided for information purposes only. The existence of a link on this website does not signify that we endorse either the linked website or its content, and we will not bear any responsibility for them.

9) Confidential Information includes, but is not limited to, information disclosed in connection with delivering the services to you. It shall not include information rightfully obtained from a third party or information available in the public domain. We and you both agree not to disclose, reveal or make use of any Confidential Information obtained from the other for any purpose other than for delivery of the services.

10) We pride ourselves in offering the highest level of professional standards and customer service throughout our relationship with you.

11) You acknowledge that use of Lifestyle Pivoting services does not involve diagnosis or treatment of mental or physical health conditions and that coaching offered is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, medical care or other qualified wellbeing therapist and it is your responsibility to seek such independent professional support as needed.

12) We may change our terms and conditions regarding the use of this website at any time at our discretion and without notice. By continuing to use our website you accept our terms as displayed on our website from time to time and you acknowledge your obligation to revisit these terms and conditions periodically to ensure that you are aware of the terms and conditions which apply at the time of your use of this website.

These terms and conditions and all other content contained on this website shall be governed by Scottish law and any dispute relating thereto shall be determined exclusively by the Scottish courts.
